1. Acceptance of these terms
By downloading, accessing, or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services. If you are using the Services on behalf of another person, you represent that you are authorized to accept these Terms on their behalf.
2. Eligibility
You must be at least 13 years old to use the Services. To create an account or purchase a subscription, you must also be the age of majority in your jurisdiction (or have the consent of a parent or legal guardian who agrees to these Terms). You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. We are not liable for any loss arising from your failure to safeguard your credentials.
4. Peony+ subscription, billing, and cancellation
Some features are offered through a paid subscription (“Peony+”). The following terms apply to subscriptions:
- Billing. Subscriptions are billed in advance on a recurring basis (for example, monthly or annually) through the app store or payment processor you used to subscribe, at the price displayed at the time of purchase.
- Auto-renewal. Your subscription automatically renews at the end of each billing period unless you cancel it beforehand. You authorize us and our payment processors to charge your payment method for each renewal.
- Cancellation. You may cancel at any time through your app store account or device subscription settings. Cancellation takes effect at the end of the current billing period, and you will retain access to Peony+ until then.
- Price changes. We may change subscription prices; we will give you advance notice as required by law and by the applicable app store, and changes take effect on your next renewal.
- Refunds. Except where required by law or by the applicable app store’s policies, payments are non-refundable and there are no refunds or credits for partially used periods.
5. User content and license
“User Content” means the answers, prompts you respond to, photos, and other material you submit through the Services. You retain ownership of your User Content. You grant Peony a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely as needed to operate, provide, and improve the Services — for example, to sync and reveal answers between you and your partner. You represent that you have the rights necessary to submit your User Content and that it does not violate these Terms or any law.
6. Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, harassing, abusive, or fraudulent purpose;
- Upload content that is illegal, infringing, defamatory, obscene, or that violates the rights of others;
- Attempt to access accounts, data, or systems you are not authorized to access;
- Reverse engineer, decompile, scrape, or interfere with the Services or their security;
- Introduce malware or otherwise disrupt the integrity or performance of the Services; or
- Resell, rent, or commercially exploit the Services without our written permission.
7. Intellectual property
The Services, including their software, design, text, graphics, the question decks, the Peony name, and logos, are owned by Peony or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive license to use the Services for your own personal, non-commercial use. No other rights are granted, and all rights not expressly granted are reserved.
8. Third-party services
The Services rely on or link to third-party services — such as app stores, payment processors, and analytics providers — that are governed by their own terms and privacy policies. We are not responsible for third-party services, and your use of them is at your own risk.
9. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any content or prompts will meet your expectations. Peony is intended for entertainment and connection and is not a substitute for professional, medical, or relationship counseling.
10. Limitation of liability
To the maximum extent permitted by law, Peony and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Peony and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or the rights of any third party.
12. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services, with or without notice, if you violate these Terms or if we reasonably believe it is necessary to protect the Services or other users. Sections that by their nature should survive termination — including content licenses you granted, disclaimers, limitations of liability, and indemnification — will continue to apply.
